# Gibraltar goods transaction-tax transition v0.1

> **Source-cited draft.** Professional review is pending. Figures are limited to the periods and assumptions below. This Guide prepares working papers; it is not authority to file or pay.

## Scope

Prepare an evidence-led review of goods imports and the 2026 transaction-tax transition. This is a transition research draft, not a customs declaration or an exhaustive commodity-rate catalogue.

Sources were accessed on 22 October 2026. A dated rate table controls its stated period; an undated guidance page does not prove that all later amendments have been incorporated.

## Effective-period control

The government's September notice states that the Treaty arrangements were provisionally applied on **15 July 2026**. Its March explanation describes transaction tax as a goods-import charge, not retail VAT and not a tax on services. Do not reproduce an older “no VAT” statement as a conclusion that goods carry no indirect tax. [23 September notice](https://www.gibraltar.gov.gi/press-releases/minister-arias-vasquez-publishes-transaction-tax-deductions-rules-2026-6922026-12358); [government tax explanation](https://www.gibraltar.gov.gi/press-releases/government-corrects-transaction-tax-misinformation-2012026-11816).

The March announcement described an initial standard 15% rate, with reduced 5% and zero rates for specified goods. It predates commencement. **It does not substitute for the operative charging provisions, commodity classification or customs valuation.** Obtain those before issuing a rate conclusion for an actual import.

## Working-paper procedure

1. Record import date, importer, commodity, origin, consignment documents, customs procedure and goods location at transition.
2. Identify the operative provision and rate for that commodity on that date. Record customs valuation and excise separately.
3. Reconcile the assessed transaction tax to the customs declaration and payment evidence.
4. Keep indirect tax paid distinct from a possible income-tax deduction. Neither is automatically a customer retail-price uplift.
5. Review transitional stock, bonded storage, exemptions and relief eligibility before estimating a liability.

**Illustration only:** if an approved classification and valuation establish a £1,000 taxable base at 15%, tax is £150. This calculation does not establish whether freight, insurance or excise enters the base for the actual item. A £1,000 retail selling price is not, by itself, the required base.

## Transitional business relief

The September announcement describes relief for qualifying certified retail/wholesale businesses for the first 90 days from 15 July, ending 12 October 2026: the excess of transaction tax over the counterfactual import duty, capped at 50% of preceding-period tax. It specifies exclusions, compliance conditions, OFT certification, payment evidence, state-aid limits and incompatibility with another support scheme. An extension requires its own evidence. [Government announcement](https://www.gibraltar.gov.gi/press-releases/minister-arias-vasquez-publishes-transaction-tax-deductions-rules-2026-6922026-12358); [Transaction Tax (Deductions) Rules 2026](https://www.gibraltarlaws.gov.gi/legislations/transaction-tax-deductions-rules-2026-8890).

**Release blocker:** reconcile the enacted charging legislation, commencement, valuation and complete commodity schedules, and check for an extension after 12 October. This draft must not be used to claim that the transition is fully verified.

## Self-checks and output

- Retain the relevant source version, the applicable period and the facts establishing scope.
- Reconcile every input to the client's records; keep estimates separate from actual amounts.
- Recompute the example and boundary cases before applying the method.
- Record exclusions and unresolved points explicitly. Do not convert a missing source into an exemption.
- Deliver a calculation, evidence list, filing calendar and reviewer questions. Record the exact revision reviewed.

## Disclaimer

General tax and accounting reference material only. These drafts have not been professionally attested. A qualified professional in the relevant jurisdiction must check the facts, current law, elections and deadlines before anyone files, pays or acts on an output.
