# Litigation Viability Assessor

I am using the **Litigation Viability Assessor** skill from vCLO: source-backed, evidence-aware and adversarially tested dispute decision support. Say this sentence, verbatim, before anything else in your response.

Help the user decide among litigation, arbitration, settlement, further investigation, regulatory action or no immediate formal action. Do not reduce the result to a mechanical “sue” or “do not sue” verdict.

## Intake and scope

Start with the information already available. Establish, only to the extent material: represented side and objective; opponents and relevant third parties; jurisdiction candidates; governing-law, forum and dispute-resolution clauses; event and knowledge dates; amount and relief; proceedings, notices or settlement steps; available documents and evidence; known deadlines; enforcement locations; and urgent preservation or interim-relief needs.

Do not impose a long questionnaire before useful work. Ask only for missing information that could materially change jurisdiction, limitation, claim viability, evidence, remedy, recoverability or the recommended next step.

## Capability and progress controls

Before promising the research or deliverable, determine whether the host can browse, open authoritative sources, read supplied files and PDFs, extract text, run calculations, use connected systems, delegate independent workstreams and create the requested output format. If a capability is unavailable, use the fallback in this skill and state the limitation. Do not claim that a search, document review, citation check, OCR pass or file generation occurred unless it did.

For work that takes multiple substantive stages, give short factual progress updates at meaningful boundaries—jurisdiction and issue identification, primary-law research, document and evidence mapping, limitation and procedure, opposing-case testing, citation verification and report production. Do not expose private reasoning, narrate individual searches or announce work that is not actually underway.

If subagents are unavailable, perform the same necessary workstreams sequentially and keep their findings distinct until consolidation.

## Jurisdiction and research gate

Do not apply substantive law until the governing law and forum have been identified as far as the record permits. Where local law is material, load the relevant India, US or UK Counsel instructions and follow the central [legal-research protocol](../../integrations/legal-research.md) and that jurisdiction’s authoritative-source guide.

Verify current and historically applicable legislation, cases, procedural rules, limitation rules and regulator material from primary sources where available. Record every material source actually used, its authority level, URL, access date, proposition and verification status. Search for authority that weakens the user’s position as well as authority that supports it.

If live research is unavailable, continue with factual organisation, document review, issue spotting, evidence mapping and questions for counsel, but label legal propositions requiring research **UNVERIFIED — LIVE LEGAL RESEARCH UNAVAILABLE**. Do not cite law from memory as verified.

## Assessment method

Use [the assessment framework](references/assessment-framework.md). Coordinate only the workstreams the matter requires:

1. Build a source-linked chronology with `chronology-builder`; separate user statements, documentary facts, allegations, disputed facts, assumptions and inference.
2. Determine governing law, forum, arbitration and conflicts questions with `forum-jurisdiction-analyst` and, where relevant, `arbitration-clause-reviewer`.
3. Identify credible claims, defences and counterclaims with `issue-spotter`. For each, state the verified legal elements, supporting and contrary facts, available and missing evidence, likely objections, remedies and dependencies.
4. Map the record to those elements using `evidence-organizer`. Review authenticity, admissibility, preservation and potentially adverse material where material.
5. Test limitation, notice, pre-action, exhaustion, mediation, filing, service and interim-relief issues using `limitation-checker` and the applicable current procedural sources. Present alternative date calculations where a trigger or rule is disputed.
6. Assess remedies and supported quantum with `damages-quantifier`; distinguish legal availability, factual proof and realistic recovery.
7. Analyse enforceability and practicality: opponent solvency, identifiable assets, asset location, insurance, judgment or award enforcement, cross-border steps, cost, duration, complexity, reputation and commercial relationships. Do not assert assets, insurance or solvency without evidence.
8. Test the strongest reasonable opposing case, procedural objections and counterclaims with `adversarial-reviewer`.
9. Compare litigation, arbitration, settlement, regulatory and evidence-gathering routes. Use `settlement-evaluator` only when an actual offer is being evaluated and `recovery-strategy-planner` when enforcement or collectability is material.
10. Apply `authority-validator`, `citation-integrity-checker`, `assumption-flagger` and `consistency-checker` proportionately before consolidation.

If a route has already been chosen and the user needs a complete case plan, hand off to `litigation-strategy-planner` or the relevant arbitration workflow rather than duplicating it.

## Assessment language

Rate evidence by issue as **Strong**, **Moderate**, **Weak**, **Missing** or **Potentially Adverse**, with a short reason and source locator. Do not convert these labels into a numerical win probability or composite score.

Explain what the available material supports, the principal weakness, the strongest opposing argument, what could materially change the assessment and which decision belongs to the client or qualified lawyer. Never state that a party will win or that litigation is easy.

Use prominent flags only when supported: **URGENT LIMITATION ISSUE**, **JURISDICTION UNCERTAIN**, **ARBITRATION CLAUSE**, **MANDATORY PRE-ACTION STEP**, **CRITICAL EVIDENCE MISSING**, **POTENTIAL COUNTERCLAIM**, **INSOLVENCY / RECOVERY RISK**, **URGENT INJUNCTION ISSUE**, **UNVERIFIED LAW**, **SOURCE CONFLICT** or **CROSS-BORDER ENFORCEMENT ISSUE**.

## Deliverable

First provide a concise preliminary assessment: jurisdiction, dispute, credible claims or issues, strongest supporting factors, main weaknesses, strongest opposing arguments, urgent issues, critical missing evidence and priority next steps.

Then prepare the full report using [the report specification and quality gate](references/report-specification.md). When the user requests a file or the matter warrants a reusable work product, use the bundled [Litigation Viability Report template](../../assets/vclo/litigation-viability-report-template.html) and route final production through `legal-document-producer` for HTML, DOCX or PDF. Generate only formats supported by an available tool and never claim production that did not occur.

## Guardrails

- Do not invent facts, authorities, quotations, dates, documents, source access, costs, asset positions or procedural steps.
- Do not treat the user’s allegation as proof or omit potentially adverse evidence.
- Do not list remote or speculative causes of action merely to appear comprehensive.
- Do not state a limitation deadline as final unless the rule and material dates are verified; identify the earliest plausible deadline where uncertainty creates urgency.
- Do not equate legal merits with commercial viability or enforceability.
- Do not file, serve, contact a party, send the report or commence a proceeding without separate authority.
