# Managing Regulatory Submissions

## Why This Skill Exists

Regulatory submissions (NDA, BLA, MAA, IND, CTA) are the formal vehicle for obtaining marketing authorization or permission to conduct clinical trials. The Common Technical Document (CTD) format, harmonized through ICH M4, is required by FDA, EMA, PMDA, and 50+ other regulatory authorities. Submissions that are incomplete, poorly organized, or non-compliant with eCTD technical specifications trigger refuse-to-file decisions, information requests, and review delays measured in months. This skill encodes the CTD structure, eCTD publishing requirements, and submission-management workflow for FDA and EMA pathways.

## Checkpoint A — Intake and Scoping

### Required Intake Questions
1. What submission type is required (IND, NDA 505(b)(1), NDA 505(b)(2), BLA, ANDA, PMA, MAA, CTA)?

## Step 1 — Organize the CTD Module Structure

The ICH M4 Common Technical Document has five modules:

### Module 1 — Administrative Information (Region-Specific)
- 1.1: Cover letter
- 1.2: Application form (FDA Form 356h for NDA/BLA; EMA application form)
- 1.3: Product information (FDA prescribing information/labeling; EMA SmPC, PIL, label)
- 1.4: Patent information and exclusivity claims
- 1.5: Financial certifications/disclosures (21 CFR 54)
- 1.6: Environmental assessment (or claim for categorical exclusion)
- 1.12: Pre-submission correspondence (meeting minutes, agreements)
- 1.14: REMS (if required)
- 1.15: Pediatric information (Pediatric Study Plan, extrapolation strategy)

### Module 2 — Summaries (the most critically reviewed sections)
- 2.2: Introduction
- 2.3: Quality Overall Summary (QOS)

## Step 2 — Develop the Submission Timeline

Create a reverse-timeline from the target submission date:

For rolling submissions, define the sequence plan (which modules go first; typically Module 3, then Module 4, then Module 5, then Module 2).

## Step 3 — Manage eCTD Publishing

Ensure technical compliance with electronic submission requirements:

1. **Document format**: PDF (Module 3-5 study reports); XML backbone per ICH eCTD specification
2. **PDF specifications**: Bookmarks, hyperlinks, page orientation, font embedding, no password protection, accessible per Section 508
3. **File naming**: Follow ICH eCTD file-naming conventions (no special characters, maximum path length compliance)
4. **Granularity**: Individual documents per the ICH granularity guidance (each CSR as a separate document, each stability study as separate)
5. **Lifecycle management**: Track document status (new, append, replace, delete) for each sequence; maintain document-level lifecycle per eCTD DTD
6. **Validation**: Run eCTD validation tool (FDA eValidator, Lorenz validator) before submission; resolve all errors and warnings
7. **Regional XML**: Include regional Module 1 XML per FDA or EMA specifications

## Step 4 — Write Module 2 Summaries

Module 2 is the interpretive layer and the most read portion of any submission:

### 2.5 Clinical Overview
- Integrated narrative across all clinical studies
- Benefit-risk framework (structured as: benefits, risks, risk management, uncertainties)
- Comparison with approved therapies
- 30-50 pages for typical NDA

### 2.7 Clinical Summary
- 2.7.1: Biopharmaceutics and PK — absorption, distribution, metabolism, excretion, drug interactions, special populations
- 2.7.2: Clinical pharmacology — PK/PD relationships, dose selection rationale, intrinsic/extrinsic factors
- 2.7.3: Summary of clinical efficacy — by study, then integrated across studies
- 2.7.4: Summary of clinical safety — common AEs, serious AEs, deaths, discontinuations, laboratory findings, vital signs, special safety topics (hepatotoxicity, QT, immunogenicity)
- 2.7.6: Synopses of individual studies

## Step 5 — Conduct Pre-Submission QC

Execute a systematic quality review before publishing:

1. **Completeness check**: Verify every required module/section is populated; use FDA/EMA checklists
2. **Cross-reference validation**: All cross-references in Module 2 resolve to correct Module 3-5 documents
3. **Consistency audit**: Numbers in Module 2 match underlying CSRs and TLFs in Module 5
4. **Labeling review**: Prescribing information (Module 1.3) is consistent with clinical data presented in Module 2 and 5
5. **Regulatory-intelligence check**: Verify compliance with recent FDA guidance updates, advisory-committee recommendations, and therapeutic-area-specific requirements
6. **Peer review**: Independent reviewer (not involved in authoring) reads Module 2.5 and 2.7 for clarity, accuracy, and persuasiveness

## Step 6 — Submit and Manage Post-Submission Activities

1. **Submission**: Via FDA Electronic Submissions Gateway (ESG) or EMA eSubmission portal; confirm receipt acknowledgment
2. **Filing review** (FDA): Day 1-60 — FDA determines whether submission is sufficiently complete for filing; respond to any refuse-to-file issues within the specified window
3. **Information requests**: Track and respond to FDA discipline-review-team questions within the specified timeline (typically 30 days)
4. **Advisory committee preparation**: If AC meeting is scheduled, prepare briefing document, presentation materials, and response to committee questions
5. **Post-action commitments**: Track PMCs/PMRs (post-marketing commitments/requirements) agreed during review

## Quality Audit

## Guidelines

1. Module 2.5 Clinical Overview is the most important document in the submission — invest disproportionate review time here
2. Never submit data that has not been through a formal QC process; every number in Module 2 must trace to a source in Module 5
3. For rolling submissions, maintain a master tracking document showing which modules/sections have been submitted in which sequence
4. The cover letter (Module 1.1) should highlight regulatory designations, meeting agreements, and any novel aspects of the submission
5. Address known regulatory concerns proactively in Module 2.5 rather than waiting for information requests
6. For 505(b)(2) submissions, the right-of-reference letter must be included and referenced in Module 1
7. Annual reports for INDs must be submitted within 60 days of the IND anniversary per 21 CFR 312.33
8. Track all FDA/EMA correspondence and file in Module 1.12 in chronological order
9. Mark any module section that is incomplete or awaiting final data with [VERIFY] and a target completion date
10. This skill produces submission-management documentation — final submission requires authorized signatory approval and legal/regulatory review
