description: "Mayotte reference distinguishing the absence of local VAT from customs and octroi de mer obligations on goods. Explains EU customs-territory membership, import declarations, separate destination taxation and the need for tariff classification and exemption evidence. Uses French customs guidance and flags conflicting VAT recodification dates in retrieved tax publications rather than prescribing an unverified future invoice citation. Services, detailed valuation, product tariffs, electronic reporting and independent accountant review are outside this initial source-cited draft; no claim of comprehensive territorial coverage is made."

# Mayotte: VAT boundary and goods imports

## Local VAT status is not a customs exemption

French customs states that **VAT is not applicable in Mayotte**. It also distinguishes membership of the French/EU customs territory from exclusion from the EU fiscal territory and identifies external octroi de mer and regional octroi as relevant local taxes. Therefore an invoice without local VAT does not establish that an import has no border tax or declaration obligation. [Customs: trade with Mayotte](https://www.douane.gouv.fr/fiche/vos-echanges-commerciaux-avec-mayotte).

This Guide concerns goods and territorial treatment. It does not establish the place-of-supply treatment of a particular service, tax registration elsewhere or the supplier's complete invoice obligations.

## Import declarations and octroi

The customs guidance requires an import declaration at the import customs office and says other imported goods are subject to external and regional octroi, with conditional treatment for local production. It does not give a universal product rate or a blanket small-business exemption. [Customs import section](https://www.douane.gouv.fr/fiche/vos-echanges-commerciaux-avec-mayotte).

For a shipment file, obtain the commodity description and classification, origin, dispatch location, customs status, customs value evidence, shipping costs, intended use and any claimed exemption decision. These are research inputs, not a claim that the same tariff or exemption applies to all imports. Verify the applicable Mayotte tariff and effective date before calculating a liability. The 2025 national octroi circular explains the separate import/local-delivery categories and regional rate-setting structure. [Customs circular, chapters I and VII](https://www.douane.gouv.fr/sites/default/files/2025-07/16/Circulaire-octroi-de-mer10072025.pdf).

Example: goods ordered from mainland France for delivery into Mayotte still require a destination customs and octroi analysis. The absence of Mayotte VAT does not by itself establish a zero landed-tax cost. No octroi percentage is assumed in this illustration. [Customs](https://www.douane.gouv.fr/fiche/vos-echanges-commerciaux-avec-mayotte).

## Goods leaving Mayotte

Check the destination's import treatment separately. Customs' general overseas VAT guidance treats the overseas departments as export territories relative to mainland France and other EU member states. Its Mayotte page says goods sent onward are exposed to the taxes normally due at arrival. Do not read the Mayotte page's generic list of possible taxes as imposing octroi in every mainland destination. [Customs: VAT in the overseas departments](https://www.douane.gouv.fr/fiche/tva-dans-les-dom); [Mayotte export section](https://www.douane.gouv.fr/fiche/vos-echanges-commerciaux-avec-mayotte).

## Legal references and unresolved recodification

The customs page cites CGI article 294(1) for Mayotte's VAT non-application. Retrieved tax-authority publications give inconsistent dates for replacing CGI references with the CIBS, and a direct current-date Légifrance fetch failed. The non-application statement is corroborated by customs, but this research has not completed the amendment chain governing the precise new reference and commencement. Do not use this Guide to prescribe a future CIBS invoice citation. [Customs](https://www.douane.gouv.fr/fiche/vos-echanges-commerciaux-avec-mayotte); [tax-authority DOM tax page](https://www.impots.gouv.fr/professionnel/questions/quels-impots-dois-je-payer-pour-mon-activite-dans-les-dom).

Current product tariffs, exemptions, detailed customs valuation, service transactions and electronic reporting obligations still need separate verification. The tax-authority URL returned a maintenance page when directly opened; the research record distinguishes that from retrieved search text. Independent source review and accountant attestation remain pending.
